Public Notice Inviting Submissions under Section 223 Local Government Act 1989

Greater Dandenong City Council (“Council”) gives notice under Section 189 and 190 of the Local Government Act 1989 (Act) that it intends to provide easement rights and lease an interest over part of the Council owned site that forms part of the Springvale Town Hall Site at 397 Springvale Road Springvale, as described below (Proposal).

The lease is for use as an electrical substation (Lease) over part of the Council owned land at 397 Springvale Road Springvale and easement rights associated with the substation.  The lease will be to United Energy Distribution Pty Ltd (United Energy) for a period of 30 years with an option for a further 20 years at a peppercorn rental.

The Proposal is that this Lease be granted as requested by United Energy as the electricity service provider for the Springvale Town Hall Site in order for Council to be able to carry out the improvement works of the Town Hall and further development proposals in the immediate vicinity.

Any person may make a submission on the Proposal under section 223 of the Act but must do so in writing to the undersigned by 24 August 2017.

Any person making a submission should clearly indicate if they wish to be heard in support of their submissions. Persons making submissions will be contacted to provide information regarding a meeting to hear submissions. All submissions will be considered in accordance with section 223 of the Act.

Submissions made under section 223 of the Act are not confidential and

  • will be incorporated in full (including any personal information) into the agenda and minutes of any Council or Committee meeting at which the matter is considered; 
  • will be provided on Council’s website as part of any relevant Council or Committee agenda and minutes; and
  • must be made available for public inspection in accordance with the provisions of the Act.

Following consideration of submissions, Council may resolve to lease the land and create an easement or take no further action in relation to this Proposal.
