Public Notice - Discontinuance of Roads in Greater Dandenong

Public notice inviting submissions under Section 223, Local Government Act 1989 Proposed Road Discontinuances
Greater Dandenong City Council (“Council”), acting under Section 206 and Clause 3 of Schedule 10 of the Local Government Act 1989 (“the Act”), proposes to discontinue roads, shown below in the three Proposals:
Three sections of road known as part of Alexander Avenue, Pyke Street and Dallimore Court, Dandenong currently included within Fotheringham Reserve being more particularly described as part of R1 on LP6870, shown hatched on the plans below and Council will then transfer this land to Council ownership for inclusion within Fotheringham Reserve.
Road located between 49-51 Callander Road and 26 Jenkins Street, Noble Park and more particularly described as R1 on LP50877, shown hatched on the plan below. It is proposed that part of the land will be sold to the abutting occupying owner for $12,000 plus GST. This is an amount less than market value because it is considered that benefits will accrue to the community by the transfer to the abutting occupying owner, as the land will be used for open space and landscaping and will support the development of the land for use as accommodation for adults with disabilities. Council policy allows for Council to set a price lower than market value where there are circumstances which justify setting a lower price.
Road located at the rear of 98-102 Kirkham, Dandenong and more particularly described as part of road on LP41414, shown on hatched on the plan below. It is proposed that the land will be sold to the abutting occupying owner in accordance with the Council policy.
In accordance with Section 223 of the Act, any person wishing to make a submission on the proposals must do so in writing to the undersigned by close of business on 15 March 2018 and should include a reference to the section of road being discontinued. Submissions should be addressed to:

Any person making a submission should clearly indicate if they wish to be heard in support of their submissions. Persons making submissions will be contacted to provide information regarding a meeting to hear submissions. All submissions will be considered in accordance with section 223 of the Act.
Submissions made under section 223 of the Act are not confidential and:
will be incorporated in full (including any personal information) into the agenda and minutes of any Council or committee meeting at which the matter is considered;
will be provided on Council’s website as part of any relevant Council or committee agenda and minutes; and
must be made available for public inspection in accordance with the provisions of the Act.
Following consideration of submissions, Council may resolve to discontinue all of the roads referred to in the Proposals, some of the roads or none of the roads and if the roads are discontinued the land will be transferred in accordance with the information provided for each Proposal.
If the roads, or part of the roads, are to be discontinued, they are to be discontinued subject to any right, power or interest held by a public authority in the land in connection with any sewers, drains, pipes, wires or cables under the control of the authority in or near the land.
